Fall River Client Charged with a Domestic Assault & Battery Acquitted by Jury

The defendant was charged with a domestic assault and battery after his former girlfriend had called the Fall River Police alleging the defendant had physically assaulted her.  At trial, the former girlfriend testified she had confronted the defendant about an incident and he became violent pushing her around and eventually throwing her to the ground. She testified she then locked herself into the bathroom and called 911.  Through cross-examination, criminal defense attorney James Powderly challenged the credibility of the alleged victim by confronting her with prior inconsistent statements and by establishing her prior feelings of ill will and hostility toward the defendant.  After a short deliberation, the Fall River Jury returned a Not Guilty verdict.
