WEST YARMOUTH – On Monday, December 20, 2010 at 10:08 a.m., the Yarmouth Police Department received information that a woman had been seriously injured during an attack that had occurred sometime Saturday night in room 12 at the Cape Cod Vacation Condominium Complex located on Route 28 in West Yarmouth.

Jose Gonzalez, 47, of West Yarmouth, charged with Felony Assault and Battery while Armed with a Dangerous Weapon (a blunt object).

Yarmouth Police Patrol Officer Brian Niezgoda met with the manager of the complex and confirmed that a woman had been attacked late Saturday night and was currently a patient at Cape Cod Hospital.  Patrol Officer Niezgoda teamed up with Yarmouth Police Detectives Eric Nuss and Russell Giammarco and eventually was able to identify the victim and her attacker.

Midday Monday, Detective Giammarco located the suspect, who is the boyfriend of the victim, hiding in the bathroom of room 11 at the Cape Cod Vacation Condominium Complex. The suspect, identified as Jose Gonzalez, 47, of room 12 at the complex, was brought to Yarmouth Police Headquarters and was subsequently placed under arrest.  Gonzalez was charged with Felony Assault and Battery while Armed with a Dangerous Weapon (a blunt object).

The investigation is ongoing.  Yarmouth Police have received assistance from the Massachusetts State Police Detectives and the Massachusetts State Police Crime Scene Services Unit.

The victim of the attack is currently in critical but stable condition at Cape Cod Hospital.

Gonzalez was initially booked at Yarmouth Police Headquarters and held overnight on $15,000 cash bail at the Barnstable County Correctional Facility in Bourne.  He was arraigned Tuesday in Barnstable District Court.
